1. Overview
JouleIO ("we", "our", "us") respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy describes the procedures we follow when we receive a notification of alleged copyright infringement on our website, jouleio.com.
In accordance with the DMCA (17 U.S.C. § 512), we have designated an agent to receive notifications of claimed copyright infringement. We will respond promptly to valid DMCA notices and take appropriate action, including removing or disabling access to material that is claimed to be infringing or that is the subject of infringing activity.
2. Filing a DMCA Takedown Notice
If you are a copyright owner or an agent authorized to act on behalf of a copyright owner and believe that content available on JouleIO infringes upon your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include the following information, as required by the DMCA:
- Identification of the copyrighted work. A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
- Identification of the infringing material. A description of the material that you claim is infringing and that you want removed or access to which you want disabled, along with sufficient information to allow us to locate the material. Please provide the specific URL(s) of the page(s) containing the allegedly infringing material.
- Your contact information. Your name, mailing address, telephone number, and email address so that we can contact you regarding your notice.
- Statement of good faith belief. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Please use "DMCA Takedown Notice" as the subject line of your email to ensure prompt processing. We aim to acknowledge receipt of all DMCA notices within two (2) business days.
4. Processing of DMCA Notices
Upon receipt of a valid DMCA takedown notice that meets the requirements outlined above, we will take the following steps:
- Acknowledge receipt of the notice to the complaining party.
- Review the notice to confirm it includes all required elements under the DMCA.
- Promptly remove or disable access to the allegedly infringing material if the notice is valid and complete.
- Notify the user or content provider whose material was removed, if applicable, and provide them with a copy of the takedown notice.
- Preserve records of the notice and our response for legal compliance purposes.
If your notice is incomplete or does not contain all the required elements, we may not be able to process it. In such cases, we will contact you to request the missing information before taking action.
5. Counter-Notification
If you believe that material you posted on JouleIO was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated agent. A valid counter-notification must include the following:
- Your contact information. Your name, address, telephone number, and email address.
- Identification of the removed material. Identification of the material that has been removed or to which access has been disabled, including the URL where the material appeared before it was removed.
- Statement under penalty of perjury. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- Consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which JouleIO may be found, and that you will accept service of process from the person who provided the original DMCA takedown notice or an agent of such person.
- Signature. Your physical or electronic signature.

6. Counter-Notification Processing
Upon receipt of a valid counter-notification, we will:
- Forward the counter-notification to the original complaining party.
- Inform the complaining party that the removed material will be restored in ten (10) to fourteen (14) business days unless we receive notification that the complaining party has filed a court action seeking a restraining order against the content provider.
- Restore the removed material between ten (10) and fourteen (14) business days after receiving the counter-notification, unless our designated agent receives notice from the complaining party that a court action has been filed.
7. Repeat Infringers
In accordance with the DMCA and other applicable law, JouleIO has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts or access of users who are deemed to be repeat infringers. JouleIO may also, at its sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
We define a repeat infringer as any user against whom we have received more than two (2) valid DMCA takedown notices for which the user has not filed a successful counter-notification. We reserve the right to determine what constitutes a "repeat infringer" at our discretion and to take appropriate action without prior notice.
8. Misrepresentation Warning
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney's fees.
Filing a false DMCA takedown notice or counter-notification is a serious legal matter. Before submitting a DMCA notice, please carefully consider whether the use of the copyrighted material constitutes fair use under Section 107 of the Copyright Act. If you are unsure whether material you are reporting infringes your copyright, we strongly recommend consulting a qualified attorney before filing a notice.
JouleIO will not be held liable for any damages or claims arising from the submission of false or misleading DMCA notices or counter-notifications by third parties.
9. Fair Use
JouleIO respects the fair use doctrine as codified in Section 107 of the Copyright Act (17 U.S.C. § 107). Before submitting a DMCA takedown notice, copyright owners should consider whether the use of their work on our website constitutes fair use. Fair use factors include:
- The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.
- The nature of the copyrighted work.
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
- The effect of the use upon the potential market for or value of the copyrighted work.
We encourage copyright owners to evaluate all four fair use factors before concluding that infringement has occurred. JouleIO is primarily an educational and informational platform providing free energy calculators and related content. Many uses of third-party material on our site may qualify as fair use for educational or commentary purposes.
10. Modifications to This Policy
JouleIO reserves the right to modify this DMCA Policy at any time. Any changes will be effective immediately upon posting to this page. The "Last updated" date at the top of this page indicates when the policy was most recently revised. We encourage users to review this policy periodically. 11. Limitation of Liability
JouleIO acts in good faith to respond to DMCA notices and counter-notifications in compliance with applicable law. We are not liable for any damages arising from the removal or restoration of content pursuant to the DMCA process, including but not limited to loss of revenue, loss of traffic, reputational harm, or business interruption.
Our response to DMCA notices is limited to the actions described in this policy and required by applicable law. We do not provide legal advice and cannot mediate disputes between copyright owners and content providers.
